The webinar will explore a highly topical and complex issue: how English courts have developed a practice of issuing provisional worldwide FRAND licences before foreign courts have ruled on infringement, validity, or remedies in standard-essential patent (SEP) disputes.
During this session, experts Dr. Niccolò Galli (European University Institute) and Prof. Giacomo Pailli (Università di Palermo), moderated by Axel Ferrazzini, will examine recent cases involving companies such as Panasonic and Acer. The discussion will explore whether this emerging British approach, and the subsequent responses from courts across Europe, risk becoming priority-seising tools rather than protective measures. The speakers will also present a proposed framework based on consent, jurisdiction, security, and proportionality.
